Terms of Service

EFFECTIVE OCTOBER 8, 2026

The agreement between Alfa Systems LLC and the businesses, admins and workers who use Alfahr. Written in plain language.

01

The agreement

Alfahr is a product of Alfa Systems LLC, 30 N Gould St. Suite B, Sheridan, WY 82801, USA. These Terms of Service (“Terms”) are an agreement between Alfa Systems LLC (“Alfahr”, “we”, “us”) and the person or organisation that uses Alfahr (“you”). They cover the Alfahr website and admin portal, the Alfahr mobile app for iOS and Android, the Alfahr API, and related support (together, the “Service”).

By creating an account, creating a workspace, accepting an invitation, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy explains how we handle personal information. It forms part of these Terms.

02

Who these terms apply to

“Customer” means the business or organisation that creates a workspace. “Admin” means a person the Customer authorises to manage the workspace. “Worker” means a person invited to a workspace to record time.

If you create a workspace for a business, you confirm that you have authority to bind that business to these Terms. The Customer is responsible for its Admins and Workers and for how they use the Service.

You must be at least 18 years old, or the age of majority where you live, to create a workspace. The Service is a workplace tool and is not directed to children.

03

Accounts and workspaces

You sign in with your email address and a one-time code or a password. Keep access to your email and your devices secure. You are responsible for activity under your account.

Give us accurate information when you sign up and keep it up to date. Tell us promptly if you believe your account has been accessed without permission.

The Customer decides who is an Admin, a manager or a Worker in its workspace, and which sites, schedules and rules apply.

04

Plans and payment

Free plan. A workspace is free for its first 10 Workers. No credit card is required.

Paid plans. If a workspace needs more than 10 Workers, or features that are not part of the free plan, the Customer may move to a paid plan. Prices, billing periods and payment methods are those shown in the Service or agreed with us in writing at the time.

We may change what the free plan includes. If a change reduces what an existing free workspace can do, we will give at least 30 days’ notice by email or in the Service.

05

Your responsibilities as an employer

The Customer is the employer or engaging organisation. Alfahr is a record-keeping tool. The Customer is responsible for:

  • Complying with employment, wage, working-time, tax and data protection laws that apply to it and its Workers.
  • Telling Workers that Alfahr is used, that a location is captured when they clock in, clock out or take a break, and why. Where the law requires consent or another legal basis, the Customer must have it.
  • Setting sites, geofences, schedules, overtime, rounding, break and approval rules correctly for its business.
  • Reviewing and approving timecards before relying on them for pay or client billing.
  • Any decision it makes about a Worker based on data in the Service.

Alfahr does not provide legal, payroll or tax advice. Default settings in the Service are starting points and may not match the law where you operate.

06

Location data

The mobile app captures a single GPS position at the moment a Worker clocks in, clocks out, or starts or ends a break. It does not track location between those actions. The Privacy Policy describes this in full.

Location accuracy depends on the Worker’s device, its settings and the conditions on site. We do not guarantee that every position is exact, or that a geofence will correctly accept or reject every punch. Flagged punches are there for the Customer to review.

07

Acceptable use

You must not:

  • Use the Service to break the law or to infringe anyone’s rights.
  • Use the Service to monitor people who are not your Workers, or to monitor Workers outside their work in ways they have not been told about.
  • Falsify punches, locations or timecards, or help anyone else to do so.
  • Try to access another customer’s workspace or data.
  • Probe, scan or test the Service for weaknesses without our written permission, or get around security or usage limits.
  • Copy, resell or sublicense the Service, or reverse engineer it, except where the law allows this despite a contract.
  • Upload malicious code or use the Service to send spam.
  • Use the API in a way that exceeds published limits or harms the Service for others.
08

Customer data

“Customer Data” means the information that the Customer, its Admins and its Workers put into the Service, including profiles, sites, schedules, punches, locations, timecards and requests.

The Customer owns its Customer Data. The Customer gives us permission to host, process, transmit and display Customer Data as needed to provide, secure and support the Service, and as described in the Privacy Policy.

For Customer Data about Workers, the Customer is the data controller and Alfahr processes that data on the Customer’s instructions. If the Customer needs a separate data processing agreement, it can ask us for one.

We may use information that does not identify any Customer or person, such as aggregated usage statistics, to operate and improve the Service.

09

API and integrations

Admins may create API keys. Treat API keys as secrets. The Customer is responsible for all use of its keys and for any third-party system it connects. We are not responsible for what a third-party system does with data the Customer sends to it.

10

Mobile app

The app is licensed to you for use with the Service, not sold. Your use of the app is also subject to the terms of the app store you downloaded it from. Apple and Google are not parties to these Terms and are not responsible for the app or for support.

Mobile data charges from your network operator are your responsibility.

11

Availability and changes

We work to keep the Service available, but we do not promise that it will be uninterrupted or free of errors. We may carry out maintenance, and we may add, change or remove features. If we remove a feature that a paying Customer relies on, we will give reasonable notice where we can.

Punches made without a network connection are stored on the device and sent when the connection returns. A punch that has not yet synced can be lost if the app is removed or the device is lost or reset.

12

Our intellectual property

Alfahr and its licensors own the Service, including the software, design, text and trade marks. These Terms give you a right to use the Service while you comply with them. They do not transfer any ownership to you.

13

Feedback

If you send us suggestions, we may use them without any obligation to you.

14

Confidentiality

Each party will keep the other’s non-public business and technical information confidential, use it only for the purpose of this agreement, and protect it with reasonable care. This does not apply to information that is public, already known, independently developed, or that must be disclosed by law.

15

Term, suspension and ending

These Terms apply for as long as you use the Service.

The Customer may stop using the Service and delete its workspace at any time. Any person may ask us to delete their own account on our account deletion page.

We may suspend or end access to the Service if you seriously or repeatedly break these Terms, if a paid plan is not paid for after notice, if we are required to by law, or if your use creates a security risk. Where we reasonably can, we will give notice first and a chance to fix the problem.

Before a workspace is closed, the Customer can export its timecards. After a workspace is deleted, we delete or anonymise its data within 90 days, except where we must keep it by law, as described in the Privacy Policy.

16

Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we exclude all warranties that are not set out in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that timecards, hour totals or location records are free of error. The Customer must check them before relying on them.

17

Limit on liability

To the fullest extent the law allows:

  • Neither party is liable to the other for lost profits, lost revenue, lost business or any indirect, special or consequential loss.
  • Our total liability for all claims connected to the Service in any 12-month period is limited to the greater of the amount the Customer paid us for the Service in that period and USD 100.

Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, or rights that a person has under consumer or data protection law.

18

Indemnity

The Customer will defend and compensate Alfa Systems LLC for claims brought by a third party, including a Worker or a regulator, that arise from the Customer’s breach of section 5 or section 7, or from the Customer’s instructions about Customer Data.

19

Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws rules, except where mandatory consumer or local law provides otherwise. Unless the law says otherwise, the state and federal courts located in Wyoming have exclusive jurisdiction over any dispute, except that either party may seek urgent relief in any court that has jurisdiction.

Before starting a formal claim, each party will try in good faith to resolve the dispute by contacting the other and discussing it for at least 30 days.

20

Changes to these terms

We may update these Terms. If a change is material, we will tell workspace Admins by email or in the Service at least 14 days before it takes effect. If you keep using the Service after the change takes effect, you accept the updated Terms. If you do not agree, you may stop using the Service and delete your workspace.

21

General

These Terms and the Privacy Policy are the whole agreement between you and us about the Service. If a court finds part of these Terms unenforceable, the rest stays in force. If we do not enforce a term, that is not a waiver. You may not transfer this agreement without our consent. We may transfer it as part of a merger, acquisition or sale of assets. Neither party is liable for delay or failure caused by events beyond its reasonable control.
